Types of easements
How wide is a drainage easement?
There is no single width. A drainage easement covers the swale, ditch or pipe plus the strip crews need to reach it, so the number on your recorded plat or grant controls, and open channels run wider than buried pipe.
A drainage easement is sized to the water it has to carry and the machinery that has to maintain it. A shallow swale between two lots can sit in a narrow strip. A deep open ditch or a detention channel needs room for its banks, a maintenance track beside it, and a place to stack cleaned-out material.
Buried storm pipe is usually the narrowest case, because the strip only has to give a crew room to excavate along the pipe. Open channels and ponds are the widest, since the easement has to include the whole water surface and its slopes.
Many local governments set minimum widths in their subdivision or stormwater design standards, and those minimums apply to new plats. They do not rewrite an older recorded easement. The width that binds your lot is the dimension on the plat, the recorded grant, or the drainage plan recorded with the subdivision.
What this looks like in practice
Picture a rear-yard swale that carries runoff from three lots to a street inlet. The recorded strip has to hold the swale, its gentle side slopes and room for a mower or small excavator. If the swale is later deepened or widened, the owners are still bound by the original dimension, but the county may argue the work stayed inside the strip.
Buried storm pipe is different. The strip may look narrow on the plat, yet the crew still needs working room on both sides when the pipe fails. That is why a fence, shed or retaining wall that seems clear of the pipe can still sit inside the recorded strip.
What to do next
- 1Find the lot on the recorded plat and read the drainage easement note and its dimension in feet.
- 2Pull the recorded plat or grant from the county recorder, clerk, or register of deeds; many offices publish a free online index.
- 3Ask a surveyor to stake the strip if you plan to build, fence or regrade near it.
- 4Call the local stormwater or public works office to ask who maintains the channel and whether grading changes need approval.
What to look for
- A dimension in feet on the recorded plat, often written beside the lot line it follows.
- Whether the strip is measured from the lot line, the center of the pipe, or the top of the channel bank.
- Wording such as "drainage and maintenance" or "access", which shows crews may drive along the strip.
- Notes about a pond, detention area or overflow path that widen the strip at one spot.
Questions people ask next
Can I fill in a drainage swale on my lot?
Usually not without approval. Changing how water moves can flood neighbors, and the easement holder typically has a right to keep the channel open. Ask the local stormwater office before moving soil.
Who pays to maintain a drainage easement?
It depends on the document and local practice. Some local governments maintain public drainage strips, while in other subdivisions the owners or an association are responsible. The grant or plat note usually says.
Does a drainage easement count toward my lot size?
Generally yes. You still own the land, so it counts toward lot area, though it often cannot be built on, which shrinks the usable portion.
